Store Terms of Service
This English version is a reference translation. The Japanese version (日本語) is the authoritative text.
These Terms of Service (hereinafter these "Terms") set forth the conditions for using the website shamisen.app (hereinafter the "Site") operated by irohamo (hereinafter "we," "us," or "our") and the sheet music store provided within the Site (hereinafter the "Store"). Users shall use the Site and the Store upon agreeing to these Terms.
For the terms relating to the "ShamiScore" app, please see the App Terms of Service.
Article 1 (Application)
These Terms apply to all relationships between the user and us relating to the use of the Site and the Store.
Article 2 (Service Content)
The Store is an online store that sells and delivers digital data of shamisen sheet music (PDF files and .shami files).
The content of the Store may be changed, added to, or terminated without prior notice.
Article 3 (Account Registration)
Login via a Google account (OAuth authentication) is required to purchase and download sheet music in the Store.
Users shall appropriately manage, at their own responsibility, the Google account used for login. We assume no responsibility whatsoever for any damage arising from unauthorized use of an account.
We may suspend or delete an account without prior notice if we determine that the user falls under any of the following.
- Where the user has violated these Terms
- Where it is found that there is falsehood in the registered information
- Where we otherwise determine that continued use is inappropriate
Article 4 (Fees and Payment)
Payment for the sheet music sold in the Store is made through the payment service provider Stripe. Displayed prices are in Japanese yen and include consumption tax.
We do not collect or retain users' credit card numbers or other payment information. This information is handled securely by Stripe.
Once a purchase is completed, the digital data of the purchased sheet music becomes available for download from My Page.
Article 5 (Provision of Digital Content and Refunds)
The sheet music sold in the Store is digital content that becomes immediately downloadable upon completion of purchase.
Due to its nature, we cannot accept returns or refunds for reasons attributable to the customer after purchase. Please understand this in advance.
However, in the following cases, we will respond on an individual basis upon inquiry.
- Where there is a technical defect, such as a corrupted file or inability to download, that cannot be resolved even through our response
- Where a file with content significantly different from the product description has been provided
- Where a refund is otherwise deemed necessary under applicable laws and regulations
If a refund is decided, we will, in principle, process the refund through Stripe to the same payment method used at the time of purchase.
Article 6 (License of Purchased Content)
The data of the sheet music sold in the Store may be used only for the personal use (performance, practice, study) of the purchasing user themselves.
Users must not engage in the following acts with respect to data purchased in the Store.
- Redistribution, resale, lending, or sharing to third parties (whether online or offline)
- Unauthorized uploading to file-sharing services, social media, websites, etc.
- Commercial use (for-profit concerts, streaming, etc.). Please consult us separately about a license
- Modification, and the creation and publication of derivative works
- Analysis, reverse engineering, or attempts thereof
Management of files after purchase (including local backups) shall be done at the user's own responsibility.
Article 7 (Re-downloading)
Purchased sheet music can, in principle, be re-downloaded any number of times from My Page.
However, for technical or operational reasons, we may change, suspend, or terminate the re-download function without prior notice. Users are recommended to download and store the files on their own devices promptly after purchase.
Article 8 (Prohibited Acts)
In using the Site and the Store, users must not engage in the following acts.
- Acts that violate laws and regulations or public order and morals
- Acts related to criminal activity
- Acts that interfere with the operation of the Site
- Unauthorized access or attempts thereof
- Acts of unauthorized use of another person's account
- Unauthorized use of credit cards, trial input not intended for payment (so-called card testing), etc.
- Acts of analyzing, modifying, or reverse engineering the Site's software, etc.
- Acts that infringe copyrights or other intellectual property rights
- Acts of uploading, sharing, or distributing sheet music, audio sources, data, etc. without the permission of the rights holder (including unauthorized sharing of content purchased in the Store)
- Acts that cause disadvantage or damage to other users or third parties
- Other acts that we determine to be inappropriate
Article 9 (Intellectual Property Rights)
Copyrights, trademark rights, and other intellectual property rights relating to the Site and the Store belong to us or the legitimate rights holders.
Copyrights, master recording rights, and other rights to the sheet music sold in the Store belong, in principle, to us or the rights holder of each musical piece. Use beyond the scope of personal use set forth in Article 6 requires separate permission from the rights holder.
Article 10 (Change or Termination of Service)
We may change, suspend, or terminate all or part of the Site and the Store without prior notice to users.
If we terminate the Store, we will endeavor to give users advance notice to a reasonable extent and to provide a period for re-downloading purchased content.
We also do not guarantee operation on specific browsers or devices.
Article 11 (Disclaimer)
We do not guarantee that the Site and the Store are free of de facto or legal defects (including, but not limited to, safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, and security).
We assume no responsibility whatsoever for any damage incurred by users due to the use of, or inability to use, the Site and the Store. However, this does not apply in cases of our willful misconduct or gross negligence.
Article 12 (Suspension of Use)
If a user violates these Terms, we may restrict use, suspend the account, or suspend access to purchased content without prior notice. We assume no responsibility for any damage arising therefrom.
Article 13 (Privacy)
The handling of personal information on the Site and the Store shall be governed by the separately established Store Privacy Policy.
Article 14 (Changes to the Terms)
We may change these Terms when we deem it necessary. The revised Terms take effect from the time they are posted on the Site.
Article 15 (Governing Law and Jurisdiction)
These Terms are governed by the laws of Japan. In the event of a dispute relating to the Site or the Store, the court having jurisdiction over our location shall be the exclusive agreed jurisdiction of first instance.
